TITLE AND EXTENT OF APPLICATIONS:

1.1 |
This shall be called the
RIM Trainee Disciplinary Rules and Regulations, 2006 |
| |
1.2 |
It shall apply to all trainees of the
Institute unless specified otherwise. |
| |
|
|
| 2. |
EFFECT: |
| |
2.1 |
The Rules and Regulations shall come
into force with retrospective effect from
1st January 2006. |
| 3. |
Membership: |
| |
3.1. |
The Committee shall comprise of the
following members:
Members: Registrar
Members: Head Departments
Members: Concerned Course Coordinators
Members: Hostel Warden
Members: Dodum(s)
Members: Puen Leaders & Co- Leaders
Members: Concerned Class Captain |

3.2 |
The Committee shall elect a Chairperson,
and Member Secretary from amongst the
Registrar and the Head of Departments. |
| |
3.3 |
The Committee shall enjoy the power
to adjudicate a case in the event the trainees are found
to have been guilty of violating the Hostel Rules and
Regulations and General Rules and Regulations of the
Institute during the training period. |
| |
The recommendation of the
Committee shall normally be the basis for a disciplinary
action to be taken by the Management. |
| 4. |
RESPONSIBILITIES:
Specifically, the Committee shall be responsible for: |
| |
4.1. |
Ensuring that all Hostel and General
Rules and Regulations are observed by the
trainees in the interest of the institute. |
| |
4.2. |
Inspect Hostel and Classrooms from time
to time to ensure effective functioning of
the Institute. |
| |
4.3. |
Holding discussion/consultation with
the trainees to give their views and suggestions for
improving and developing a workable system as and when
required: |
| |
4.4. |
Acting as the advisory body in relation
to trainee related disciplinary issues for
proper management of the Institute. |
| |
4.5. |
Ensuring that the values such as accountability,
discipline, professional standards, innovation and team-
spirit are inculcated/respected by the trainees; and |
| |
4.6. |
Taking appropriate disciplinary actions
in the event of non-compliance of Rules and
Regulations. |
| 5. |
PROCEDURES: |
| |
5.1. |
The Committee shall meet as and when
required to hear and review the case of the
trainees' breach of discipline with respect to the rules
of the Institute and in-country
training rules and also to discuss matters of common
concerns. |
| |
5.2. |
The Member Secretary with the prior
approval of the Chairperson shall call the
meeting and also record and maintain the minutes of
the meeting. |
| |
5.3. |
A meeting shall be convened immediately
to address issues that need urgent attention
brought to the notice of the committee by a concern
person. |
| |
5.4. |
A case shall be investigated with
utmost care and sincerity and the party (ies)
involved shall be given adequate and reasonable opportunity
to defend the charges if
there is (are) any. |
| 6. |
MAINTENANCE OF DRIGTHRIM: |
| |
6.1. |
The following clauses shall constitute
as offences/act of gross indiscipline punishable
under rules in force; |
| |
|
| 6.1.1. |
Violation of provision of the
RIM Rules and Regulations, including Civil Service
Training Rules, RIM circulars and RIM orders; |
| 6.1.2. |
Physical assault of any form; |
| 6.1.3. |
Practices derogatory to the status,
dignity and honour of the faculty, staff and
trainees; |
| 6.1.4. |
Act of drugs abuse and any other
substance abuses; |
6.1.5. |
Religious intolerance or communal
hatred; |
| 6.1.6. |
Possession of fire arms (licensed
or otherwise); |
| 6.1.7. |
Gambling of any kind; |
| 6.1.8. |
Non official duty related visits
to each others hostel and staff quarters; |
| 6.1.9. |
Willful destructions and unauthorized
possession of the Institute’s properties; |
| 6.1.10. |
Unauthorized movement of the Institute’s
properties; |
| 6.1.11. |
Any incidence of indecent acts,
clandestine affairs between trainees and
faculty/staff; |
| 6.1.12. |
Non-compliance to Driglam Namzha
including habitual absence and
un- punctuality; |
| 6.1.13. |
Non-participation in morning physical
exercise and prayer; |
| 6.1.14. |
Non-participation in social works
and co-curricular activities and |
|
| |
6.2. |
Any act that causes/disrupts the smooth
functioning of the Institute and/or acts that would
put the Institute in disrepute in the society. |
| 7. |
PENALTY:
|
| |
7.1. |
For proper maintenance of the discipline,
the Committee is hereby empowered to
recommend appropriate actions as deemed fit. |
| |
7.2. |
The Committee shall recommend
to the management any trainees to be; |
| |
|
| 7.2.1. |
expelled |
| 7.2.2. |
suspended for a stated period |
| 7.2.3. |
fined and recover compensation
claimed for the undue damages caused to
the Institute’s properties; |
| 7.2.4. |
hard labour/social works; |
| 7.2.5. |
cleaning; |
| 7.2.6. |
detention |
|
| |
7.3. |
The degree and type of penalties
to be imposed shall depend upon the seriousness of
the case as may be determined by the Committee and
recommended to the management.

7.4. |
The following actions shall singularly
or in combination form the penalties; |
| |
|
| 7.4.1. |
Violation of the clauses
6.1.1,6.1.10. and 6.1.12 will lead to imposition
of the following penalties; |
| |
7.4.1.1. |
First time commitment
------> First and last warning |
| |
7.4.1.2. |
Second time commitment ----->
Suspension from the Institute |
| |
7.4.1.3. |
Third time commitment ------>
Expulsion from the Institute |
|
| |
7.5. |
Violation of the clauses 6.1.2,6.1.3,6.1.4,6.1.5,
6.1.6,6.1.7,6.1.8 and 6.1.11 will lead to expulsion
from the Institute. |
| |
7.6. |
Non-compliance to clause 6.1.13 and
6.1.14 or failure to compensate the equivalent working
hours in case of 6.1.14 will be accounted for credits
and attendance requirements of the General Development
Programme. |
| |
7.7. |
Non-compliance to clause 6.1.9 will
lead to seizure of the property and will also enforce
the trainee to bear the cost of repair/replacement
for damages caused. |

| 8. |
INTERPRETATION AND AMENDMENTS: |
| |
8.1.1. |
The Director shall be the competent
authority to interpret the Rules and Regulations of
the Institute.
